Conditions for returning goods
The product can be returned if the following conditions are met:
Return of goods of proper quality.
According to Article 9 of the Law of Ukraine “On the Protection of Consumer Rights”, the consumer has the right within 14 days to replace the product of appropriate quality with a similar one, if the product does not fit in shape, dimensions, style, color or cannot be used for its intended purpose, but on the condition that the product has not been used and its appearance, consumer properties, seals, factory packaging, documents have been preserved.
If a similar product is not available for sale at the time of exchange, the consumer has the right to purchase any other product, or to receive money back in the amount of the value of the returned product, or to exchange the product for a similar product at the first arrival of the corresponding product for sale. When returning money, settlements with the consumer are carried out based on the value of the product at the time of its purchase. Money is returned within seven days.
The customer’s requirements are considered only after clarification of the customer’s name and order number, complete set of goods, factory packaging. Product replacement or refund is possible only if all conditions and procedures are followed.
You will be denied a replacement or refund if:
• the product, which does not have significant defects, is not new, that is, it has been used;
• more than 14 days have passed since the purchase of the goods;
• when checking the quality of the product, signs of third-party intervention (disclosure, attempted repair) or other warranty service conditions are violated;
• there is no document confirming the fact of purchasing the goods or;
• incomplete product packaging.
We also draw your attention to the fact that according to Clause 3 of Article 4 of the Law of Ukraine “On the Protection of Consumer Rights” the consumer is obliged to:
1) before starting to use the product, carefully familiarize yourself with the operating rules set out in the product documentation provided by the store;
2) if it is necessary to obtain an explanation of the conditions and rules for using the product – before starting to use the product, contact the seller for clarification;
3) use the product in accordance with its intended purpose and comply with the conditions (requirements, norms, rules) established by the manufacturer of the product in the operational documentation;
4) in order to prevent negative consequences for the consumer regarding the use of the product, follow the safety methods provided by the manufacturer in the product and the special rules provided for in the operating documentation, and in the absence of such rules in the documentation, follow the usual clear safety methods established for products of this type.
The return and replacement of goods sent by the online store to different cities of Ukraine is carried out by the buyer by delivery services, in particular “Nova Poshta”, and is paid for by the buyer.
Before sending the goods, the buyer must contact the representative of the online store, discuss the terms of shipment and obtain the data of the recipient of the cargo (representative of the online store).
Refunds are made by transfer to the buyer’s card.
In the event that the reason for the return or replacement was the improper quality of the product, the store will pay for the return shipment.
If the purchased product was of proper quality, but for some reason did not suit the buyer, then the buyer pays for the return shipping.
Return of goods of inadequate quality
According to Article 8 of the Law of Ukraine “On the Protection of Consumer Rights”, in the event of significant defects arising from the fault of the product manufacturer, during the warranty period, the consumer has the right to replace the product or return the money.
According to clause 12 of Article 1 of the Law of Ukraine “On the Protection of Consumer Rights”, a significant defect is considered to be a defect that makes it impossible or inadmissible to use the product in accordance with its intended purpose, which arose due to the fault of the manufacturer, after its elimination, it appears again due to factors independent of the consumer reasons and at the same time endowed with at least one of the following signs:
a) it cannot be eliminated at all;
b) it takes more than fourteen calendar days to eliminate it;
c) he makes the goods significantly different from what is provided for in the contract
The consumer’s request for replacement of the product is subject to immediate satisfaction if it is available, and in case of its absence – within two months from the moment of submission of the application. If it is impossible to satisfy the demand within the established period, then the consumer has the right, at his choice, to demand the replacement of the product with defects for another product of another brand (model) of the appropriate quality with a corresponding recalculation of the price or a refund. Consumer requests for a refund must be satisfied within seven days. Settlement with the consumer in the event of an increase in the price of the product is carried out – based on the value of the product at the time of its purchase.
In case of disagreements regarding the quality or causes of defects, the online store has the right to conduct an independent examination at its own expense. The buyer can participate in the examination and appeal its decision in court. If, as a result of the examination, it is established that the defects of the goods were caused by the fault of the Buyer, then the Buyer is obliged to reimburse the online store for the cost of the examination, as well as the costs associated with its conduct for transportation and storage of goods.
